Buchpreisbindung bei eBooks

Hinzu kommt, dass in Deutschland ein Verlag für gedruckte Bücher 7%, auf Ebooks aber 19% MwSt. abführen muss. Die Frage nach dem Sinn lassen wir mal außen vor, "verteuert" aber eben für den Verlag das Ebook.

Eine andere, ebenfalls ältere Kalkulation, die aufzeigt, dass beim Preis für ein Ebook ggf. kalkulatorisch durchaus Spielraum (nach unten aus Sicht des Käufers) ist, aber neben Verlag und Leser auch immer Autor und Handel mit im Spiel sind: http://www.buchreport.de/blog.htm?p=3265

We have been researching and discussing the Buchbindungspreis law. Our intent is to honor the law as best we can. We do have many difficulties honoring it for both technical and operational reasons. We are also based in the USA not Germany, and our website simultaneously sells to anyone in the world with an internet connection. As you know the Buchbindungspreis only affects German language books, so a lot of our title catalog is not affected.

 

On our marketplaces, publishers set the prices their books. We can inform the publishers of the law, but we are not set-up to force them to comply with it. Our legal agreement with publishers does not give us the right to change the publishers' prices.

 

We do not have a technical mechanism in place to price a book one-price for a user coming from a German IP address and a different price for all other users. Even if we did have this, many users would fake an IP address. To strictly comply we would have to have advanced location detection based on IP address and billing information, neither of which is perfect for an ebook where nothing is shipped to a physical address.

 

The law does allow ebooks to have different prices from physical books.

Also, the law affects only new books (release < 18 months), and there are some ways publishers might exempt titles from the law (for example alter the appearance of the front cover & disclaimer and claim the PDF as „book club“ title)

Also the law does not count for any subscriptions, and we have a subscription tool in our marketplace that some publishers use.

 

So in the end, the amount of coding required to strictly comply (to allow every exception but catch every case where prices should be fixed, but only for certain customers) is beyond what is reasonable for a company of our size. We will inform our publishers about the law, and see what we are able to do to honor the spirit of the law.

Das Problem damit ist das sie mit einer Nicht-Compliance einer Abmahnung Tür und Tor öffnen.....
Wobei das eher das Problem der Verlage ist, die müssen dafür Sorge tragen das in D, AT, CH verkaufte Bücher den hiesigen Gesetzen was Preisbindung angeht, entsprechen.

Bin hier kein Anwalt, aber supereinfach ist das mit dem Gesetz auch jetzt nicht.
